Supreme Court refuses to stay the proceedings against the Foundation

The Supreme Court on Monday refused to stay the proceedings against the foundation of BJP MP Gautam Gambhir in a case related to illegal purchase and distribution of COVID-19 medicines.
Justice D.Y. Chandrachud and Justice MR. Shah’s bench said that people were circling for medicines and in this situation suddenly a trust says that we will give you medicines. The bench refused to entertain the petition saying that it was not correct. We don’t want to say anything, but we also keep an eye on things. The court asked the petitioner to approach the Delhi High Court and seek appropriate relief. Senior advocate Kailash Vasdev, appearing for the foundation, urged a stay on the proceedings in the matter under the Drugs and Cosmetics Act. Seeing the stand of the bench, the lawyer of Gambhir Foundation withdrew the petition.

The Drug Controller of Delhi Government had earlier informed the Delhi High Court that Gautam Gambhir Foundation has been found guilty of illegal storage, purchase and distribution of Fabiflu drug for COVID-19 patients. The court had expressed displeasure with the way medicines were procured in huge quantities and said that those who really needed medicines at that particular time could not get them as the bulk of the medicines were procured by cricketer-turned-politician Gambhir. . The court was informed that AAP MLA Praveen Kumar has also been found guilty of such offense under the Drugs and Cosmetics Act and action would be taken against him.
