Supreme Court issues notice to UP government, ‘Amar Dubey’s wife was a minor at the time of incident’

The Supreme Court on Wednesday agreed to hear the bail plea of Amar Dubey’s wife, a close aide of mafia gangster Vikas Dubey. Vikas Dubey was killed in a police encounter in Uttar Pradesh last year. A bench of Justice S Abdul Nazeer and Justice Krishna Murari said that it is issuing notice to the Uttar Pradesh government in the matter.

Senior advocate Vivek Tankha, appearing for Amar’s wife, said she was a minor at the time of the incident and was in the correctional home for the past one year. Eight policemen were killed on the night of July 3 in Bikru village of Kanpur’s Chaubepur area when they were on their way to arrest Vikas Dubey and were attacked.
Tankha said that it is a case of an innocent person being present at the wrong place, at the wrong time as she was married to Amar Dubey seven days before the incident. He said the woman was not named in the FIR lodged after the July 3 incident, while her husband Amar Dubey was made accused number 14 in the FIR.
The petition, filed through advocate Sumir Sodhi, said that the petitioner was a minor on the date of the incident and at the time of registration of the FIR and was made an accused and arrested merely because of the fact that her husband’s name was in the FIR. The bench questioned Tankha as to his age at the time of the incident. He replied that his age was 16 years 10 months and 12 days on the day of the incident. The bench said that it would like to hear the side of the state of Uttar Pradesh in this matter and hence it is issuing the notice.
