Supreme Court bans Madhya Pradesh Panchayat Election! OBC reservation became the reason

The biggest news is coming out regarding the Madhya Pradesh Panchayat Election. In fact, the Supreme Court today heard the petition filed regarding the Panchayat elections and after the hearing, the Panchayat elections have been stayed. The Supreme Court has ordered that OBC seats be notified again. Let us tell you that the Supreme Court has just put a stay on the election process in the seats reserved for OBC category. A bench of Justices AM Khanwilkar and CT Ravikumar has directed the State Election Commission to re-notify the general category seats and notify them for the general category. As reported by LiveLaw, the bench found that the notification of OBC reservation was against the earlier judgment of the Supreme Court of Vikas Kishanrao Gawli Vs Maharashtra State.

The Supreme Court has said that if the law is not followed, then elections can also be canceled in future. The Supreme Court will now hear the matter next on January 27. The Supreme Court emphasized that due to similar OBC quota, the local elections in Maharashtra were also stayed. Senior advocate Vivek Tankha appeared on behalf of the petitioner in the court. On the other hand, Advocate Siddharth Seth and Advocate Karthik Seth kept the side of the State Election Commission.

Vivek Tankha said that the court has directed the State Election Commission to conduct elections according to the Constitution. Reservation rotation system has not been followed in Madhya Pradesh, which is a violation of Article 243 (C) of the Constitution.

‘Don’t play with fire’

The Supreme Court said in its order that “Kindly don’t play with fire. You should understand the situation. Don’t take decisions on the basis of political compulsions. Will every state have a different pattern? There is only one constitution and you have to follow it. Supreme Court is also same. This is irresponsible behavior of Election Commission. It is not acting responsibly. You were also there when a similar order was given. We don’t want any experiment to happen in Madhya Pradesh. It has to be seen according to the Maharashtra case.”

Let us inform that earlier a petition was filed in the High Court demanding a stay on the election due to non-compliance of the rotation system in the election. However, refusing to hear the petition immediately, the High Court said to hear it on January 3. On this, the petitioner approached the Supreme Court and the Supreme Court, accepting the petition, fixed the hearing on Friday.
