Sharad Yadav will have to vacate the government bungalow, Delhi High Court has given instructions

The High Court on Tuesday directed former Janata Dal (United) president Sharad Yadav to vacate the government bungalow found in the capital as an MP within 15 days. Yadav was disqualified as a Rajya Sabha MP in 2017.

A bench of Acting Chief Justice Vipin Sanghi and Justice Navin Chawla said more than four years have elapsed since Yadav was disqualified and there was no justification for him to retain his government residence.

The bench said that it quashes the interim order of December 15, 2017 restraining the single judge from vacating the bungalow. The single judge allowed Yadav to take advantage of the official facilities and facilities of an MP, including the use of the official residence at Tukhlak Road.

In June 2018, the Supreme Court partially modified the High Court order, saying he could retain his official residence but would not be entitled to salary and other benefits.

The High Court on Tuesday disposed of a writ petition by the Center seeking to lift the stay on vacating a government bungalow occupied by them in the capital. The Center had said that Yadav has been disqualified as a Rajya Sabha MP in 2017, so he is not entitled to stay in the bungalow.

Yadav had approached the High Court in 2017 challenging his disqualification from the Rajya Sabha on several grounds, including not giving him an opportunity to be represented by the Chairman of the Rajya Sabha before passing the order.
