Uttar Pradesh : Big statement of former High Court judge on demolishing house in Prayagraj – “It is completely illegal”

“This is completely illegal. Even if it is assumed that the house was built illegally, as millions of Indians live like this, still it cannot be accepted that you demolish the house while the person is in custody. There is no technical issue here, it is a question of law.”

The Prayagraj Development Authority on Sunday, June 12, completely demolished the two-storey house of local activist and Welfare Party of Indian leader Mohammad Javed. The police accused him of being the main conspirator of the violence that took place in the city after Friday prayers on June 10. But at the same time, the authority pasted a notice on his house on June 11. Pasting the notice said that some part of his house comes under the category of illegal construction, and before taking action, he should vacate the house.

However, the family and the lawyer have termed the police’s allegations as completely baseless.

The house was in the name of the wife!

Javed’s lawyer KK Rai said that the house demolished by the Prayagraj administration was not in Javed’s name. That house was in the name of his wife Parveen Fatima.

They said, “The house which was in the name of Parveen Fatima, which was gifted by her father, by issuing a notice in the name of the person who has no ownership of the house, the administration has demolished Parveen Fatima and her four Children have been made homeless.”

The lawyer said that the notice which the administration is talking about has a retrospective written in it and it has been claimed that they had issued notice in this regard on May 10 and given an opportunity to present the arguments. However, the reality is that this notice was given on June 11 and the house was demolished within 24 hours.

Grandfather gifted

Sumaiya Fatima, daughter of Javed Mohammad, also told that the house which was demolished by Prayagraj Development Authority was gifted to her mother by her maternal grandfather.

They said, “Neither the land was bought nor the house was built with my father’s earnings. Now there is no way but to knock on the door of the law. There is only hope from the law.”

However, the Prayagraj Development Authority had issued a notice on June 10 saying that the provisions of the Uttar Pradesh Town Planning and Development Act, 1973 have been violated in the construction of this house located at Kareli in the city and almost without obtaining permission from the Prayagraj Authority. The ground floor and first floor have been constructed in the size of 25 by 60 feet.

The father told that Manmohan was missing from home since the incident. After which, he expressed doubt that maybe his son had committed the murder and set the room on fire. The police already suspected the son The police immediately registered a case against the son and started investigation. After which, on the night of 14 August, the police arrested Manmohan Singh from Kulhal area. During interrogation, Manmohan Singh confessed his crime. He told that he has been addicted to drugs for a long time. He has already gone to jail in drug smuggling and Arms Act cases. On the day of the incident, he had asked his mother for money for drugs. But his mother refused to give him money and also did not let him go out of the house. He fled with the money after the murder After which, Manmohan Singh, in anger, attacked his mother’s neck with a wooden stick kept in the house. Due to which she died on the spot. After the murder, Manmohan Singh wrapped the body in a mattress and set it on fire so that it appeared that the woman died due to burning. Manmohan fled on a motorcycle with 30 thousand rupees kept in the cupboard of the house and his clothes.
