Letter from 117 dignitaries of the country to CJI, wrote- ‘Sc crossed Lakshman Rekha with its remarks in Nupur Sharma case’

The remarks made by the Supreme Court on Nupur Sharma have been criticized by many former judges and have written a letter to the Chief Justice of India complaining about it. In the letter of former Kerala High Court judge Justice Raveendran, 15 retired judges, 77 retired bureaucrats, 25 retired army officers have signed and supported his statement. Let us tell you that Nupur Sharma had filed a petition in the Supreme Court to club together all the cases registered against her in different states of the country.

During the hearing of Nupur’s petition, a bench of Supreme Court Justice Surya Kant and Justice JB Pardiwala, while making oral remarks, said that her statement is responsible for setting fire to the country. After this remark, different organizations are complaining by writing letters to the Chief Justice every day. Justice PN Raveendran, a former judge of the Kerala High Court, has written a letter to the Chief Justice saying that with this remark, the Supreme Court has crossed the Lakshman Rekha. His letter is signed by 117 former officers and judges of the judiciary, bureaucracy and the army.

What is written in the letter sent to the Chief Justice?
In the letter of former judge Justice PN Raveendran, it is written, ‘We as responsible citizens believe that the democracy of any country will not survive unless all the institutions do not perform their duties as per the Constitution. Two judges of the Supreme Court have crossed the Lakshman Rekha in their recent remarks and have compelled us to issue this statement. The remarks of both the judges have shocked the people. These comments are not part of the judicial order. It is the legal right of a person to get the cases registered in many states of the country integrated.

What comment did the Supreme Court make in the Nupur Sharma case?
Apart from this, an organization of Jammu and Kashmir ‘Forum for Human Rights and Social Justice’ has also written a letter to the Chief Justice criticizing the Supreme Court’s remarks on Nupur Sharma. The Supreme Court made some observations on July 1 while hearing a petition by former BJP spokesperson Nupur Sharma (for clubbing the FIR against her). However, they were not mentioned in the copy of the order. The Bar and Bench quoted Justice Surya Kant, ‘The way Nupur Sharma has provoked sentiments in the whole country. This woman is responsible for what is happening in the country. We saw the debate on how they were instigated. He should apologize to the whole country.

Justice Suryakant also made several other comments reprimanding Nupur Sharma and said that she should have come on television and apologized to the entire country. Being the spokesperson of the ruling party, he does not have the license to make such statements. Justice Suryakant in his remarks also attributed the statement of Nupur Sharma to the Udaipur incident. Let us tell you that in Udaipur, fanatics Ghaus Mohammad and Riyaz Akhtari killed tailor Kanhaiya Lal by slitting his throat. After this remark of the Supreme Court, a round of criticism started on social media. It was said that such statements from the judiciary are going to raise the spirits of the fundamentalists.

Justice S.N. Dhingra calls SC’s remarks irresponsible
Retired Judge of Delhi High Court Justice S.N. Dhingra also criticized the Supreme Court’s remarks in Nupur Sharma’s case. In a conversation with a news channel, he said, ‘According to me, these comments are very irresponsible in themselves. The Supreme Court has no right to make such remarks, which may ruin the entire career of the person who has come to seek justice from him. Or let all courts be prejudiced against him. In a way, the Supreme Court imposed a charge on Nupur Sharma without listening to her and also gave the verdict. There was neither testimony, nor investigation, nor was he given any opportunity to present his explanation.
