Uddhav Thackeray faction reached the Supreme Court against the order of the Election Commission

The tussle between Shiv Sena in Maharashtra seems to be taking a new form. Uddhav Thackeray Shiv Sena faction has filed a petition in the Supreme Court regarding the order of the Election Commission. Seeking to stay the proceedings of the Election Commission on the petition of the Eknath Shinde-faction for recognition as the ‘real’ Shiv Sena. The Uddhav faction says that the Election Commission cannot determine who is the real Shiv Sena till the disqualification of the rebel MLAs is decided. Challenged the Election Commission’s order to file the Shinde faction and the Uddhav faction along with the Shiv Sena’s claim document by August 8. The Uddhav faction is terming the order of the Election Commission as unconstitutional and hasty decision. The petition has been filed by Shiv Sena General Secretary Subhash Desai of Thackeray Group.

The petition said that the Shinde faction was trying to “illegally increase the numbers and create an artificial majority in the organisation”. The issue is already pending before the Supreme Court. If the Election Commission proceeds with the matter, it will cause “irreparable damage”, which amounts to interference in judicial proceedings, investigating the matter which is sub-judice before the court. Thus it amounts to contempt of court.

The Election Commission has also asked both the factions to give in writing the reasons for the ongoing protests within the party. Earlier, in a letter to the Election Commission, state CM Eknath Shinde and his fellow MLAs have claimed to have 40 Shiv Sena MLAs and 12 MPs with them.

Let us inform that a few days ago, Chief Minister Eknath Shinde had staked claim on the Shiv Sena party. The way Eknath Shinde is growing rapidly, it seems that soon he will take possession of the bow and arrow. Eknath Shinde had written to the Election Commission that the National Executive of Shiv Sena appointed by Uddhav Thackeray has been dissolved and he has formed a new executive. Significantly, with the help of BJP, Eknath Shinde led a coup against Shiv Sena chief Uddhav Thackeray. After ousting Uddhav from power, he himself became the Chief Minister of Maharashtra.
