No bar license in the name of Smriti Irani or her daughter: Delhi High Court in defamation case

The Delhi High Court has issued an order against the Congress leaders in the defamation case of Union Minister Smriti Irani of two crores. The court has said in the order that prima facie it has been proved that there is no license of any bar in the name of Smriti Irani or her daughter. Nor does she own a restaurant and bar. Smriti Irani or her daughter has never even applied for a license. The High Court said that the show cause notice given by the Goa government has also not been issued in the name of Smriti Irani or her daughter. Prima facie, it seems that the papers presented by the petitioner Smriti Irani strengthen their stand.

The court said in its order that if the tweets/posts made by Congress leaders are allowed to remain on social media, then it will cause deep damage to the image of Smriti Irani and her family.

In para number 28 of the High Court order, it is written that Congress leaders Jairam Naresh, Pawan Kheda and Neta D’Souza along with others hatched a conspiracy and made aggressive and scathing words with malice against Union Minister Smriti Irani and her daughter in the court. Said that all the three leaders together damaged the public image and reputation of Union Minister Smriti Irani and her daughter.

Para 29 states that having perused the various documents filed by the plaintiff and the excerpts of the press conference held by the respondent no. And outrageous allegations have been made. The reputation of the plaintiff and his family has been hurt in view of various tweets and re-tweets after the press conference conducted by respondent no. 1, 2 and 3.

On Friday, the Delhi High Court had asked Congress leaders Jairam Ramesh, Pawan Khera and Neta D’Souza to remove the tweet. He ordered the removal of the tweet within 24 hours. The High Court had said that if they failed to remove the tweet, then the social media company should be removed.

Let us inform that Union Minister Smriti Irani has filed a civil suit in the Delhi High Court for defamation of two crore rupees. In fact, by issuing summons to the Congress leaders in this matter, the High Court has given time till August 18 to file their reply. The next hearing will be on November 15.
