Uttar Pradesh : Allahabad High Court Order for CBI investigation of gang who blackmailed advocates by accusing them of rape and SC-ST
The Allahabad High Court has directed a CBI inquiry into 46 cases registered in various police stations of Prayagraj including Mauaima for extortion of money in the name of return of false cases of misconduct against lawyers. Court submits preliminary inquiry report to CBI in two months? The matter will be heard on October 20. The court has stayed the arrest of the lawyers accused of misconduct till the preliminary report comes.
This order has been given by Justice Gautam Choudhary on the petition of the complainant Nikki Devi. In which the sessions court order to complete the trial of the criminal case going on for misconduct? issue was sought. A case is registered against the accused advocate Bhupendra Pandey in the Daraganj police station on charges of misconduct.
They said that a gang of High Court lawyers is active in the High Court, who extorts money from the accused in the name of return after filing of chargesheet after filing false case and divides them. Due to the victim being a Scheduled Caste, money is also received from the government. Charges have been made in this case. The court had also summoned the complainant Nikki Devi.
36 cases are registered in Mauaima police station alone
Accused advocate Bhupendra Pandey gave a list of 51 criminal cases to the court. Out of which 36 cases have been registered in Mauaima police station alone. A case has also been registered against advocate Ashish Mishra. On behalf of the accused lawyers, a team of senior advocates VP Srivastava, Gopal Swaroop Chaturvedi, Radhakant Ojha, Amarendra Nath Singh, General Secretary of the Bar SDS Jadaun defended.
The court said that the use of inherent powers is necessary to protect justice. It is necessary to entrust the investigation of the false case against the lawyers to the CBI. The court has directed senior CBI advocates Gyan Prakash and Sanjay Kumar Singh to submit the preliminary inquiry report in two months in a sealed cover.
