Bihar Assembly Speaker Vijay Sinha adamant on not resigning

So the real political game is yet to come in Bihar? These questions are being raised because Bihar Assembly Speaker Vijay Kumar Sinha has refused to resign. Or rather, they are adamant that they will not resign at any cost. Actually, it has been almost 13 days since the change of power took place in Bihar. Till now Vijay Sinha has not resigned from the post of Speaker of the Assembly. The ruling JDU and RJD are continuously demanding resignation, but they are not ready to resign. The Speaker of the Assembly says that the notice given to him is against the rules.

Speaking to reporters in Patna, Speaker Vijay Kumar Sinha said that it would not be appropriate to say anything at this time on whatever happened to preserve power in the past. But it would be unfair for me to remain silent on the questions raised on the prestige of the legislature during this period. Vijay Sinha said that as long as I am bound with responsibility, it is my duty to safeguard the dignity of democracy above my personal honour. So when a no-confidence motion was brought against me as Speaker of the Assembly, I did not see myself as lacking confidence. In the notice of motion of no-confidence which has been given to the Secretariat, the rules and provisions have been ignored. Therefore it is my natural responsibility to reject this notice.

Will not resign
The Speaker of the Bihar Assembly has clearly said that he will not resign from the post. Vijay Sinha said that a no-confidence motion has been brought against me, but I believed in myself. The notice of no-confidence motion was given to the Secretariat, in which the rules have been ignored. The most unfortunate and baseless allegations have been made in the notice, which are of personal level, being tied to the posture. As such it cannot be accepted.

No-confidence motion against speaker
After the change of power in Bihar, the leaders of the Grand Alliance headed by Lalit Yadav had presented a no-confidence motion against the sitting Speaker Vijay Kumar Singh. On August 10, a letter signed by 50 MLAs of the Grand Alliance was handed over to the Secretary of the Bihar Legislative Assembly. Under the no-confidence motion, Vijay Kumar Sinha will have to prove his majority inside the assembly to continue as Speaker. But now he has rejected the no-confidence motion.

The maximum number of days the speaker can stay in the chair
14 days after the notice of no-confidence motion is given, it can be discussed. This is the first agenda for discussion when the proceedings of the Legislative Assembly begin after the notice is given. When a no-confidence motion is taken, the speaker himself cannot preside. In such a situation, the Deputy Speaker will handle the work. JDU leader Maheshwar Hazari is the deputy speaker in the assembly. According to the law, Vijay Kumar Sinha can remain in the Speaker’s chair for a maximum of 14 days. On the other hand, the Grand Alliance will have to wait for 15 days. In such a situation, the time of 14 days is ending on 23 August and the session will be held on 24 August. But a day before the start of the session, the speaker has said that he will not resign from his post.

What will happen next
Let us tell you that the procedure for removal of Speaker and election of new Speaker is prescribed in the Conduct of Business Manual of Bihar Legislative Assembly. The special thing is that the date of election of the Speaker is fixed by the Governor of Bihar. Technically, the post of Speaker of the Legislative Assembly is not vacant yet, nor has any such information been given by the Assembly to His Excellency the Governor. As far as the election of the Speaker of the Legislative Assembly is concerned, the date is fixed by the Governor after receiving the notice of vacancy. According to the rules, a member desirous of becoming the Speaker can file his nomination with the Secretary of the Legislative Assembly only by 12 o’clock the day before the date of election.

Let us tell you that a meeting of the Legislative Assembly has been called on August 24 to get the trust vote for the new government. The working plan of the two-day session has to be prepared by the current president. There are only two things to be done in the Bihar Legislative Assembly. The first is to get the majority of the government and the second is to vote on the no-confidence motion against the Speaker. However, it is not yet known who will be the first of these and which will be the second. However, the Speaker of the Assembly has rejected the no-confidence motion of the ruling party. In such a situation, what will happen next, everyone’s eyes will be on it.
