There was a ban on 30 percent reservation for women of Uttarakhand, women candidates of UP-Haryana had filed a petition in the High Court

The Uttarakhand High Court has stayed the mandate of giving 30 percent reservation to the indigenous women of the state. On Wednesday, the court gave this decision while hearing the petitions filed against the reservation in the Uttarakhand Public Service Commission examination.
A division bench of Chief Justice Justice Vipin Sanghi and Justice RC Khulbe allowed the petitioners to appear in the examination. The government and the Public Service Commission have been asked to present their side by October 7. Women candidates of Haryana and Uttar Pradesh had filed a petition in the Nainital High Court opposing the reservation for women of Uttarakhand origin.
He said that the State Public Service Commission has given 30 percent reservation to local women in the unreserved category in the Uttarakhand Combined Civil Subordinate Services Examination for the posts of Deputy Collector and other posts. Due to this she has been out of the examination of the commission.
Ban on the mandate of 2006
The petitioners told the government’s mandate of 2006 to give reservation against Articles 14, 16, 19 and 21 of the Constitution. The court was told that no state government can give reservation on the basis of birth and permanent residence. In the petition, there was a demand for cancellation of this reservation. After the hearing, the court, while staying the mandate of reservation, asked the government and the Public Service Commission to present their side.
Advertisement was issued for 224 vacancies in 31 departments
The Public Service Commission had released the advertisement on August 10 last year for 224 vacancies in 31 departments. The result of the preliminary examination came on 26 May 2022. Two cut off lists for unreserved category were drawn in the exam. The cut off for women candidates of Uttarakhand origin was 79. The petitioner women say that their marks were more than 79, but they were excluded from the examination on the basis of reservation.
