Allahabad High Court: Bail to the accused of raping a Scheduled Caste minor girl

The Allahabad High Court has approved the bail application of Ajit Kumar, accused of abducting and raping a Scheduled Caste minor girl. The court has said that the petitioner should be released with a personal bond and two sureties. Justice Rahul Chaturvedi has given this order while hearing on the bail application of petitioner Ajit Kumar.

The court said that the rape of the girl has not been confirmed in the case. The girl has stated in her statement to the police that she stayed with the accused at various places including Varanasi, Pratapgarh, Phulpur and got married at Naulakha temple, while giving a contrary statement before the magistrate. The girl’s father lodged an FIR on March 31, 2022 at Soraon police station.

An FIR was registered on the petitioner under various sections including rape, SDSC and POCSO Act. The petitioner is in jail since 24 April 2022. During the arguments, the counsel for the petitioner argued that the petitioner has been falsely implicated in the case. Looking at the facts and circumstances, the court conditionally granted bail to the petitioner.
