Vice President Dhankhar again targeted the Supreme Court, mentioned NJAC in his first address to Rajya Sabha

Vice President Jagdeep Dhankhar once again targeted the Supreme Court and the National Judicial Commission (NJAC). mentioned the law. The 99th Constitutional Amendment Bill, paving the way for the National Judicial Appointments Commission, was passed by both the Houses of Parliament but was struck down by the Supreme Court in 2015. Rajya Sabha Chairman Jagdeep Dhankhar once again expressed deep concern about this. He said it was a “serious compromise on parliamentary sovereignty” and a “disrespect” to the mandate of which the Upper House and the Lok Sabha are the guardians.

Dhankhar, in his first address while conducting the proceedings of the Upper House as the Speaker, referred to the Supreme Court’s decision regarding NJAC and said that there is no such precedent in democratic history where a constitutional measure taken in a systematic manner has been given such a status. has been judicially rendered ineffective.

It is noteworthy that in the month of August 2014, both the Houses of the Parliament unanimously passed the 99th Constitutional Amendment with the provision of NGAC. The Supreme Court later struck down the law in October 2015 by a majority decision of four to one, saying it was not in conformity with the “Basic Structure” of the Constitution.

Dhankhar said, “We need to keep in mind that the foundation of any ‘infrastructure’ in a democratic polity is to uphold the primacy of the mandate as reflected in the Parliament….” He said that it is a matter of concern that this very important issue which is very important for the democratic fabric is not being focused by the Parliament.

Dhankhar said, “This House, along with the Lok Sabha, being the custodian of the people, is bound by an obligation to look into the issue and I will certainly do it.” High standards of dignity and purity should be maintained.

He called upon the members to work towards creating an environment that respects the Lakshman Rekha.
