SC to review its own decision to release 11 convicts in Bilkis case

The Supreme Court will review its own decision to release the 11 convicts in the Bilkis case. The Supreme Court is going to hear the matter on 13 December. A bench of Justice Bela M Trivedi and Justice Ajay Rastogi will look into the matter.

Earlier, during today’s hearing, the bench of CJI Chandrachud said that it will soon list the petition of Bilkis seeking review of that decision. The Supreme Court had allowed the Gujarat government’s plea to release the 11 convicts in the Godhra carnage.

The bench of CJI DY Chandrachud, Justice PS Narasimha, Justice Dipankar Datta said this when Advocate Shobha told that the review petition of Bilkis has not been listed yet. He said that its possible date was told as December 5. The CJI said that he thinks a date has been fixed for the matter. He will find out about it. Then the court was told that the hearing has been fixed on the 13th.

There is a way for the Supreme Court to review its decisions. The aspects of the decision are discussed in a chamber with the judges who have given the decision. Bilkis Bano has challenged the decision under which the Supreme Court had decided to release 11 convicts ahead of time. Bilkis believes that the Supreme Court needs to reconsider its decision.

Bilkis was raped during the 2002 Godhra riots. Several members of his family were also murdered. The court convicted 11 people and sentenced them. But in May this year, the Supreme Court accepted the Gujarat government’s appeal to release the 11 convicts in the Bilkis case on grounds of good conduct. The government had filed this petition under the Remission Rules of 1992.

The convicts in the Bilkis case were released just before the Gujarat elections. Regarding this, all the political parties also made a scathing attack on the BJP government. But the matter flared up again when Bilkis filed a petition for review of the verdict.
