Jagdeep Dhankhar, Rijiju insulted the constitution by commenting on collegium, Bombay Lawyers Association reached Supreme Court

The Bombay Lawyers Association has reached out to the Supreme Court demanding action against Vice President Jagdeep Dhankhar and Law Minister Kiren Rijiju of the Modi government for their remarks against the Supreme Court collegium. The association says that both the leaders insulted the constitution by commenting against the collegium, because the collegium Supreme Court is part of and apex court is an institution established under the constitution

Bombay Lawyers Association had earlier filed this petition in its High Court but the High Court dismissed it. Now the association has filed a special leave petition in the Supreme Court against the decision of the High Court. The apex court has been demanded to take action against Jagdeep Dhankhar and Kiren Rijiju. Both are not eligible to work in their posts as they have disrespected the constitution.

Damaged the image of the Supreme Court by openly criticizing

The association says that Jagdeep Dhankhar and Kiren Rijiju have tried to tarnish the image of the Supreme Court in the eyes of the public by publicly criticizing the collegium. Dhankhar is not fit to continue as the Vice President and Rijiju the Law Minister.

The Bombay High Court, while rejecting the petition of the lawyers, had said that the image of the Supreme Court is like the sky. No one can hurt him. The High Court also said that it cannot issue an order to dismiss the Vice President and the Law Minister from the post only on the demand of the lawyers.

Uproar over John Sathyan’s case

The tussle between the Supreme Court Collegium and the Central Government continues unabated. Madras High Court lawyer John Sathyan was not made a judge of the Central High Court even after the collegium’s proposal and warning. His name was recommended by the collegium on January 17. Following the recommendations made on February 9, the Center has appointed three judges as High Court judges but has kept Sathyan’s file pending. Sathyan had written an article against PM Narendra Modi.

However, the collegium says that it has overruled Satyam’s action. Therefore, the Center should not have any objection. But the Center does not seem to have forgiven Sathyan. That’s why his file has been kept under wraps. Three judges of the collegium, including CJI DY Chandrachud, passed a resolution in Sathyan’s case and also instructed the Center.
