What did the police say

Police sources said that to strengthen the charge sheet, the post-mortem report has been made the basis, in which it has been clarified that the rat’s lungs were damaged, there was swelling in them, there was also infection in the liver. Also, in the microscopic examination of the rat, it was clarified that the death of the rat was due to suffocation due to drowning in water. On November 25, 2022, in Sadar Kotwali area, a complaint was lodged with the police against a youth for drowning a rat. Later, the police registered an FIR against the accused Manoj Kumar under the Prevention of Cruelty to Animals Act and section 429 (killing any living animal) of the Indian Penal Code (IPC) and granted him bail from the police station itself.

Vikendra Sharma, an animal lover of Badayun, had seen a person named Manoj Kumar throwing a rat into a drain after tying a stone to its tail near the electricity sub-station of the district on November 25 last year. Vikendra had filed a report against this incident in Badaun Kotwali under the Animal Cruelty Act, on the basis of which this case was registered. Sadar Kotwali police sealed the dead rat and sent it to the Indian Veterinary Research Institute (IVRI), Bareilly for forensic examination.

KP Singh, Joint Director (JD) of Bareilly-based IVRI, said on December 1, 2022, “The forensic examination of the rat was done by a team of two veterinarians. In the investigation, the lungs of the rat were found swollen. Our experts came to the conclusion that the death of the rat was due to ‘lung infection and obstruction in breathing’. Senior advocate Rajeev Kumar Sharma said on Tuesday that in case of cruelty to animals act, Rs 10 to Rs 2,000. Up to fine and three years’ imprisonment and under section 429 there is a provision for both five years’ punishment and fine. Mathura Prasad, the father of Manoj, an accused in the case, said, “It is not wrong to kill a rat or a crow. These are harmful creatures.
