Madhya Pradesh: Police seized drugs, urea came out in the investigation! The High Court asked the DGP to pay Rs 10 lakh as compensation.

The Gwalior Bench of the Madhya Pradesh High Court on Friday ordered the DGP to pay Rs 10 lakh to the victim and take strict action against the responsible police officers, while taking strict action against a young man sent to jail in a false NDPS case by the police. In this case, the police claimed to have seized the dangerous drug MDMA from the accused, while the FSL investigation found it to be urea.

Murar police station of Gwalior had arrested an accused on 6 September 2022 and claimed that 760 grams of MDM had been seized from his possession. MDM is the most expensive drug product right now and is used by celebrities at pool parties. It was claimed that it was brought to Gwalior’s restaurant and farm house to be consumed in pool parties. This action of the police was also widely discussed in the media.

In this case, Murar police station registered a criminal case against the accused Rohit Tiwari under Section 8/20 of the NDPS Act and showed seizure of 760 grams of MDMA drug from him and arrested the accused and sent him to jail. The accused, through his counsel, filed a petition in the Gwalior bench of the High Court under Article 439 in this case and requested to present the FSL report of the seized material before the court. The High Court accepted that request and called for the report. The report found that the substance seized from Rohit Tiwari was not MDMA drug but urea.

Accused Rohit Tiwari’s lawyer Sunil Goswami said that the High Court found in the investigation report that the seized substance urea does not make out a case of NDPS on the accused, hence this FIR is wrong, which should be quashed. Along with this, the court agreed that Rohit Tiwari’s personal liberty was violated by keeping him in custody for nine months, for which the DGP should give him Rs 10 lakh as compensation. Along with this, instructions have been given to the investigating officers related to this case to ensure that such falls are not registered in future and action should be taken against the guilty.
