Must pass test to get compassionate job: Supreme Court

The Supreme Court has said in a judgment that it is necessary to fulfill the educational and professional qualifications in the job given on the basis of compassion. Not that he should be put in a lower grade for failing to meet the qualifications. The court said that the job given on the basis of compassion is not a right. For this, it is necessary to fulfill the qualifications. Giving this decision, the bench of Chief Justice Justice DY Chandrachud refused to give relief to the person who lost his job on the basis of Anukpa. Rehan was given the job of junior assistant in the statistics department after the death of the driver’s father. He was asked to appear in the departmental test of basic computer and typing and score minimum marks. He failed in computer and typing test.

After this he was given another chance and on this occasion also he could not pass the typing test. On this the statistics officer dismissed him from his job. He challenged this order in the Allahabad High Court and said that if he is not eligible for the post of junior assistant, then he should be given a job in class IV.

The UP government appealed against this in the division bench, but it was rejected. After this, the state government appealed in the Supreme Court and said that the order of the High Court was not proper.
