Former Supreme Court judge Justice Madan B. Lokur has criticized the stand of the Supreme Court on the petition of women wrestlers. Women wrestlers had approached the Supreme Court alleging sexual harassment by Wrestling Federation of India (WFI) President and BJP MP Brij Bhushan Sharan Singh. The wrestlers had said in their petition that the Delhi Police was not registering an FIR against Brij Bhushan Singh on their complaint.

Delhi Police should not have left like this

Justice Lokur said that the Supreme Court should not have let off the Delhi Police so easily on the delay in registering the FIR. At least the Supreme Court should have monitored the entire investigation itself. In a webinar organized by ANHAD and the National Alliance of People’s Movement, Justice Lokur said that the Supreme Court should have first asked the Delhi Police whether Why did you delay the FIR? But the Supreme Court did not do so.

The Supreme Court itself has accepted that they (wrestlers) are in danger. In such a situation, it should not have been said that if something happens in future, you can go to the Magistrate or the High Court. The Supreme Court should have said that we will personally supervise the entire investigation so that there is no mess. The Supreme Court has in the past monitored investigations in such cases.

Apparently the police have got it

Justice Madan B Lokur said that the allegations leveled by the wrestlers are very serious in nature. There have also been attempts to tamper with evidence and witnesses. The action of the Delhi Police was very slow in this whole matter and the reason for this is clear. Obviously the police are involved. And she doesn’t want the allegations and investigation to go ahead. A month has passed and what happened so far? This is not a matter which needs very thorough investigation.

Police is talking of 100 witnesses, but what is that? There won’t be a crowd witnessing the sexual assault of a minor. Now they (police) are saying that we need video evidence, whereas the sexual assault must have happened behind closed doors. So what is the point of investigation?

Wrestlers were made criminals

According to a Bar & Bench report, Justice Lokur also questioned the Delhi Police’s action against the wrestlers and said that those who were victims and had come to express their pain at Jantar Mantar were made criminals under section 144. given. Then it was said that now you cannot sit at Jantar Mantar. So where will they go? To whom will you tell your words?

Question on Anurag Thakur too?

Justice Madan Lokur also questioned Sports Minister Anurag Thakur’s statement that the probe would be completed by June 15. Justice Lokur said how did he (Anurag Thakur) know this? Any statement in this case can be given only by the Investigating Officer (IO) and no one else. At the most, he can give information related to the investigation to his senior officer or police commissioner. This means that there is something going on behind the scenes, which is very serious. Because the Supreme Court itself has said many times that no one can interfere in the investigation, not even the Supreme Court.

Why interrogate the victim for 5 hours?

Justice Lokur also questioned the five-hour interrogation of the minor victim. Said that she (the victim) has given a written complaint, in which all the things are mentioned. What kind of inquiry do you want? The victim is being asked to prove what she has alleged. This is also a form of harassment. The Supreme Court and all the courts have taken a very strict stand on this. It is like playing with the dignity of this victim.

Who is Justice Lokur?

Born on 31 December 1953, Justice Madan B Lokur retired from the Supreme Court on 30 December 2018. Justice Lokur, who studied law from Delhi University, started his career as an advocate in the year 1977. He practiced in Delhi High Court and Supreme Court. Appointed Senior Advocate in the year 1997. After this, on 14 July 1998, he became the Additional Solicitor General of India.

Justice Madan Lokur became a judge of the Delhi High Court on 5 July 1999. He was also the Acting Chief Justice of Delhi High Court from 13 February 2010 to 21 May 2010. Became the Chief Justice of Gauhati High Court on 24 June 2010. After this, from 15 November 2011 to 3 June 2012, he was the Chief Justice of Andhra Pradesh High Court. From here on June 4, 2012 the Supreme Court came.

According to a scobserver report, while in the Supreme Court, Justice Lokur gave more than 159 judgments, including important judgments such as declaring sexual intercourse with a minor as rape.
