Uttarakhand: Do you know what is enemy property? on which Dhami’s bulldozer ran

The Nainital High Court, while hearing the enemy property case, has rejected the petition of the encroachers. After the High Court refused to stop the demolition being done by the state government on the encroachments occupied by the encroachers, the people themselves started vacating the houses. While hearing the case, a two-member bench of the High Court asked the encroachers to give an undertaking to vacate the possession. After this order of the court, the encroachers refused to give the undertaking.

Due to non-giving of undertaking by the encroachers, it has become clear that now bulldozers will run on enemy properties in Nainital Metropole. After the refusal of the High Court’s ban, people themselves have started evacuating the houses. In Nainital, 134 people have occupied enemy properties, which will now be bulldozed. During the hearing in the High Court, the encroachers refused to give undertaking and argued that they have been in possession of this property for years. The Pushkar Singh Dhami government of Uttarakhand, after taking a tough stand against encroachment, illegal encroachments are being removed continuously at many places.

What did the state government tell the court?

According to media reports, Solicitor General SN Babulkar and CS Rawat, appearing for the government, told the court that in August 2010, the government had encroached upon enemy properties in the presence of their owners, a total of 116 encroachers were involved. He told the court on what basis the present petitioners are claiming their possession of these properties. At present their number has increased to 134 and now they should be removed from here.

In fact, when the petitioners did not get relief from the SDM Court and the Civil Court regarding the removal of the encroachment, they approached the Nainital High Court. Where the petitioners challenging the orders of SDM Court and Civil Court said that they have been occupying the enemy property of Nainital for years.

What is enemy property?

After independence, many people from the country settled in Pakistan. Apart from this, in view of the Indo-Pakistan war of 1965 and 1971, many people migrated from here. These people lost their property after leaving the country. Government of India declared such properties as enemy property. The first order in this regard was issued by the government in September 1959. While the second order in this regard was issued in December 1971.
