Union Home Minister Amit Shah introduced three new bills in the Lok Sabha. This includes the Indian Justice Code 2023, the Indian Civil Defense Code 2023 and the Indian Evidence Bill 2023. Now these bills will be scrutinized by the parliamentary panel. These three bills will replace Indian Penal Code 1860 (IPC), Code of Criminal Procedure 1898 (CrPC) and Evidence Act. All these three laws belong to the British era. 533 sections will be reduced in IPC, 133 new sections will be added. Section 9 has been changed. Terrorism has been defined for the first time in the new bill. Along with this, provision has been made for mob lynching, death penalty for sexual assault on minors, maximum 20 years imprisonment for rape and community service for minor crimes for the first time. All these three bills have not been passed yet. But many big things have emerged from these bills.
Presenting these bills, Home Minister Amit Shah said that the focus of the old laws was to strengthen and protect the British administration, through which people were punished, not justice. But now this will not happen. Shah said in the Lok Sabha that I can assure the House that these bills will change our criminal justice system. Our aim will not be to punish, but to provide justice. Punishment will be given to create a sense of deterrence. The old laws made by the British were full of allusions to slavery, the purpose of which was to punish those who opposed their rule.
Sedition word removed, now this will be new provision
Amit Shah said that the sedition law will be completely repealed. This is a democracy, everyone has the right to speak his mind. Therefore, the word sedition has been removed in the new bill, but according to the new provision, any person intentionally or knowingly, by spoken or written words, by signs, by showing something, by electronic message, by use of financial means, secession or armed rebellion abets or attempts to abet subversive activities, separatist sentiments, or endangers the sovereignty or unity and integrity of India, or engages in or does any such act, shall be punished with imprisonment of either description for life. shall be punished with imprisonment of either description for a term which may extend to 7 years and shall also be liable to fine.
Defined the term terrorism for the first time
The term terrorism has been defined for the first time under the Indian Judicial Code which was not covered under the IPC. The Home Minister said that earlier there was no definition of terrorism. For the first time, terrorism has been defined under the law.

What is the provision of punishment on mob lynching?
Mob lynching has been added to the definition of murder in the new bill. When a group of 5 or more persons together commits murder on grounds of race, caste or community, sex, place of birth, language, personal belief or any other ground, every member of such group shall be punished with death or imprisonment Will go. In this, a provision has been made for minimum punishment of 7 years and maximum death sentence. Apart from this, fine will also be imposed.
Law protecting men from sexual harassment ended
UNNATURAL SEXUAL OFFENSES Section 377 has now been completely abolished. So there is no law now to protect men from sexual harassment. There is no law against bestiality. Under the new law, there is no provision for punishment for unnatural sex crimes against men. The Supreme Court ruled under Section 377 that “consenting adults” cannot be prosecuted for “unnatural acts”.
Death penalty for gang rape of a minor
The Home Minister said that in the new laws, we have made many provisions for solving crimes against women and social problems. Under the new law, a provision of death penalty has been made for gang rape of a minor. While the punishment has been increased in rape cases. In this, the minimum punishment which was earlier 7 years, has now been increased to 10 years. 2. A new law has been made in the case of rape of a minor. Therefore, the punishment for raping a minor was increased to 20 years. This is a sentence of life imprisonment. A new provision has been made in the rape law. Along with this, the one who has sex by revealing the identity has been kept in the category of crime.
Hate speech will also be punished for 5 years
Hate speech and religious inflammatory speech have also been included in the category of crime in the new laws. If a person gives hate speech, then in such a case a provision has been made for imprisonment of three years and fine. Apart from this, if a provocative speech is given against any class, category or other religion by organizing a religious event, then there will be a provision of punishment of 5 years.
Snatching now punishable up to three years
A new provision has been made on “snatching” under section 302 in the Indian Code of Justice. It states that whoever commits snatching shall be punished with imprisonment of either description for a term which may extend to three years, and shall also be liable to fine.
It is a crime to have sex with women by changing identity
On the floor of the House, the Union Home Minister said that those who have sex with a woman by misrepresenting their identity, will be prosecuted under the new penal code for the first time in India. For the first time, making relation with women under false promise made with false identity for marriage, employment, promotion and false identity will come under the category of crime. The new law clearly states that if a man has sex with a woman by promising to marry her by resorting to fraud, it will be considered an offence. A man lying about his religious identity in order to have sex with a woman will also be brought under the ambit of the law. For this, a provision has been made for punishment which can be up to 10 years and the person will also have to pay a fine. The new provision also states that under Section 69, whoever fraudulently or without any intention of marrying a woman, commits sexual intercourse, such sexual intercourse shall not amount to the offense of rape. .
Revealing the identity of the rape victim will be punished
In the new law, there is a provision of punishment for revealing the identity of the rape victim. Section 72. (1) Whoever prints or publishes the name or any matter which may lead to the identification of any person against whom a provision under section 63 or section 64 or section 65 or section 66 or section 67 or section 68 has been charged with or found guilty of an offense under crime has been committed. In such a case the accused shall be punished with imprisonment of either description for a term. Which can be extended up to 2 years and fine can also be imposed. It has also been said in the draft related to rape that if the victim could not resist, it would not mean that she had consent.
All courts will be digitized by 2027
According to the new provisions, all the process from FIR to judgment will be online. The Home Minister said that by 2027 all the courts will be digitized. Zero FIR can be registered from anywhere. If anyone is arrested, his family will be informed immediately. After completing the investigation in 180 days, he will have to be sent for trial.
The judge will have to give a decision in 30 days
There will be a summary trial for sections punishable up to 3 years. Due to this, the hearing and decision of the case will come soon. The judge will have to give his verdict within 30 days of the charge being framed. If there is a case registered against the government employee, then it is necessary to give permission to run the case within 120 days. A provision has been made for harsher punishment in organized crime. The death sentence can be commuted to life imprisonment, but complete acquittal will not be easy.
Everyone will get justice in maximum three years
Amit Shah said that the changes have been made to provide speedy justice and to create a legal system keeping in mind the contemporary needs and aspirations of the people. He said that after the passing of the new law, everyone will get justice within a maximum of three years.
