Instructions for publication of three new bills, sections of CRPC and IPC will change

Vice President and Rajya Sabha Chairman Jagdeep Dhankhar on Saturday directed the dissemination and publication of the 246th report on the ‘Indian Civil Defense Code, 2023’, the 247th report on the ‘Indian Civil Defense Code, 2023’ and the 248th report on the ‘Security of India Bill’.

The report was presented on Friday by Brij Lal, Rajya Sabha MP and chairman of the department-related Parliamentary Standing Committee on Home Affairs. These were presented by Brij Lal on November 10, 2023.

The Indian Civil Protection Code 2023, the Indian Judicial Code 2023 and the Indian Evidence Bill 2023 were introduced in the Lower House of Parliament on August 11. These bills will replace the Indian Penal Code (IPC) 1860, Code of Criminal Procedure (CRPC), 1973 and the Indian Evidence Act, 1872 respectively. The bills were introduced by Home Minister Amit Shah. Introducing these, he said that the purpose of the three new laws is to protect all the rights given by the Constitution.

He said, “Actually, during the British period, laws were made to strengthen and protect the British rule. The purpose of these British laws was not to provide justice but to punish.” According to the Home Minister, “We are going to bring changes in these fundamental aspects. Its purpose will not be to punish anyone but to provide justice.” Its purpose is to create a feeling of preventing crime. “However, punishment will be given where necessary.”

Indian Civil Defense Code Bill will have 533 sections

According to Amit Shah, the Indian Civil Defense Code Bill, which will replace the CrPC, will have 533 sections. “A total of 160 sections have been changed in this bill. “9 new sections have been added to it while the same number of sections have been repealed.”

The Indian Judicial Code Bill, which will replace the IPC, will have 356 sections instead of the earlier 511 sections. While 175 sections have been amended, 8 new sections have been added. Also 22 sections have been repealed.

If we talk about the Evidence Act, the Indian Evidence Bill that replaced it will now have 170 sections instead of the earlier 167. 23 sections have been changed in this. At the same time, one new section has been added, while five have been repealed.

Difference between IPC and CrPC

The IPC contains the definition of crime and provides provisions for punishment, while the CrPC provides the procedures to be followed in a criminal case. For example, how can a criminal be arrested? Many sections of IPC will not be in the new bill. While many will be replaced. For example, section 302 for murder will be replaced by section 101. There will be provision for death penalty in case of mob lynching and gang rape.
