Sanjay Kundu gets big relief from Supreme Court, path cleared for appointment to the post of DGP

The Supreme Court canceled the order of the State High Court to remove Himachal Pradesh IPS officer Sanjay Kundu from the post of DGP. After the court order, the way has been cleared for his appointment to the post of DGP. However, the court has upheld the High Court order to conduct a SIT investigation into the allegation of threatening Sanjay Kundu against a businessman.

A bench headed by Chief Justice DY Chandrachud passed this order while hearing Kundu’s petition challenging the January 9 order of the High Court, in which the High Court had withdrawn its earlier direction to remove him from the post of DGP. His petition with the request was rejected. The bench also includes Justice JB Pardiwala and Justice Manoj Mishra.

The top court said, ‘However, it would be inappropriate at this stage to maintain the order of the High Court directing that the petitioner (Kundu) be removed from the post of DGP in compliance with the order dated December 26, 2023…’

In fact, on January 2, the Himachal government had removed Sanjay Kundu from the post. Following the orders of the High Court regarding the dispute with the businessman, the government had transferred him and posted him as the Principal Secretary of the AYUSH Department. The Supreme Court has given relief to Kundu in this case. Earlier, a recall appeal was filed in the Himachal High Court against Kundu’s removal from the post, which was rejected by the court. Then he approached the Supreme Court.

The whole matter is related to Kangra businessman
The whole matter is related to a dispute with businessman Nishant Sharma of Palampur in Kangra district of Himachal Pradesh. Sharma has a dispute with his partner regarding property. He alleges that DGP Sanjay Kundu tried to put pressure on him to solve the case. Not only this, many phone calls were made to him from Palampur DSP and DGP office.
