Uttar Pradesh: Gave up claim on 23 kg gold, may get relief in punishment… Kannauj’s perfume businessman Piyush Jain made legal move

Perfume businessman Piyush Jain has now learned the legal tricks. This move of Piyush has forced even the prosecution to think. Actually, perfume businessman Piyush Jain has given up his claim on 23 kg of gold. Jain has withdrawn his appeal claiming the gold. Along with this, an application has been filed in the court requesting that the case not be prosecuted. Experts believe that Piyush has taken this step to avoid punishment. The prosecution will file its reply on February 7.
In the raid by the team of Directorate General of GST Intelligence (DGGI), Ahmedabad, huge property worth crores was recovered from Piyush Jain’s house. 23 kg of foreign gold was recovered in it. In the lab test, foreign gold was found to be 99.86 percent pure. The customs department had seized 23 kg of gold. The value of this foreign gold was estimated at Rs 11 crore 37 lakh 35 thousand. After investigation, Customs had filed a complaint in the gold smuggling case on 12 May 2022. Whose trial has also started in the court.
Immense wealth was found from Piyush’s hideouts
The team of Directorate General of GST Intelligence (DGGI), Ahmedabad had recovered cash worth Rs 177.45 crore from Piyush Jain’s residence in Adanpuri. The investigation team recovered Rs 19 crore in cash, 23 kg of gold and 600 liters of sandalwood oil whose value was said to be around Rs 6 crore from the residence in Kannauj. The gold biscuits found from Kannauj had foreign marks. Along with this, Rs 9 lakh was recovered from the locker of SBI Bank of Kannauj. Piyush Jain came out of jail on bail on 8 September 2022.
Claim was made on 23 kg gold
A case was registered against Piyush Jain under the Custom Act after foreign gold was recovered. Lucknow Additional Custom Commissioner had imposed a fine of Rs 30 lakh on Piyush Jain and his firm Odokam on 9 April 2023. Piyush had deposited a fine of Rs 60 lakh. After this, Piyush had filed a complaint against the Lucknow Custom Commissioner claiming the gold as his own and said that it was wrongly confiscated.
Piyush withdrew his appeal on gold claim
Special Public Prosecutor Ambrish Tandon said that Piyush Jain had given an application to the Chief Commissioner Customs on December 12, 2023, requesting to drop his claim and not prosecute him. On Piyush’s application, the Chief Commissioner of Customs in Patna ordered that he should first deposit compounding fee of Rs 56.86 lakh and give up his claim on the gold. After this, an advance decision will be taken and they will be heard. After this Piyush deposited the compounding fee. Along with this, the appeal of claim on gold was withdrawn. The Chief Custom Commissioner has accepted his point.
Application for relief in case
Perfume businessman Piyush Jain has filed an application in the special CJM court. In which Piyush has talked about giving relief under the Custom Act in the case of 23 kg gold. The prosecution will file its reply regarding Piyush’s application on 7 February 2023.
