‘Court’s hammer’ on ‘Justice from bulldozer’, Rs 2 lakh. Instructions to take action against officers who demolish houses with fine

The trend of doing bulldozer justice across the country by running bulldozers on the houses of the accused has got a big blow from the Madhya Pradesh High Court. With this it is hoped that now this trend can be controlled. The reason is the decision given by the High Court in the case of demolishing the house of an accused in Ujjain. In fact, in the case of running a bulldozer on the house of an accused, the High Court has not only imposed a fine of Rs 2 lakh on the Municipal Corporation, but has also given instructions for strict action.
Actually, a case was registered against Montu Gurjar, resident of Dhancha Bhawan, in Chimanganj police station in December 2022. The allegation was that he had extorted money from a person resident of Heera Mill Chawl. It is alleged that the said person had committed suicide after being harassed by this. After this the police arrested Montu Gurjar and sent him to jail. Then, looking at his old records, as per the police letter, JCB was moved against Montu’s two-storey house declaring it illegal.

After this, Montu Gurjar’s wife Radha Gurjar had filed a case in the High Court. She had claimed that the Municipal Corporation had pasted a notice in the name of Raisa B and demolished the house without listening to her side. Whereas the house did not belong to Rahisa B nor was it illegal. The house was taken from the Housing Board and there is also a bank loan on it. The single bench of the High Court has declared the Municipal Corporation’s action in the case wrong and has ordered a fine of Rs 2 lakh and also ordered action against the corporation officials responsible for demolishing the house.
Now we will file a case for Rs 50 lakh compensation
Montu’s lawyer Ravi Sharma said that the High Court has declared the Municipal Corporation’s action completely wrong and has ordered fine and action against the officials. The court has asked to file a case in the civil court for compensation. Due to this, soon a case will be filed against the Municipal Corporation in the local court for compensation of Rs 50 lakh. Remember, Mumbai Court had also given a similar decision in the case of demolition of film actress Kangana Ranaut’s house.
Break on house demolition action
Let us tell you here that since 2018, a campaign to demolish the houses of criminals is going on in Madhya Pradesh on the lines of the Yogi model of Uttar Pradesh. Under this, bulldozers are run on the houses of the accused at any time. Similar action was taken against Montu Gurjar, but after this decision, now there seems to be a break in the criminals breaking houses.
