A delegation of Uttarakhand Congress Committee met Chief Electoral Officer BVRC Purushottam and demanded holding of assembly by-elections along with Lok Sabha elections on Mangalore and Badrinath seats. Let us tell you that BSP MLA from Mangalore Haji Sarwat Karim Ansari died on 30 October 2023.

Congress spokesperson Garima Mehra Dasauni said that late Sarwat Karim Ansari was elected MLA for the 5th Uttarakhand Legislative Assembly from 33 Mangalore Assembly Constituency. His election was challenged in the High Court by Qazi Nizamuddin. After the death of Sharbat Karim Ansari, the application to withdraw it was filed in the month of November itself.

High Court gave instructions to hold by-elections

Dasouni said that the High Court’s order on this matter was issued yesterday. In which it has been accepted to withdraw the petition. Dasouni told that Sarwat Karim Ansari died on 30 October 2023. After his demise a casual vacancy arose as per Section 150 of the Act 1951. According to Section 151-A, it is required to be filled within six months i.e. within 30th April 2024.

The delegation requested the Chief Electoral Officer to hold by-elections for Mangalore and Badrinath constituencies as soon as possible. The delegation told the Chief Electoral Officer that on April 30, 2024, six months will be completed since the death of Late Sarbat Karim Ansari. The said constituency which has no representation from 30 October 2023. This seat should get its elected representative in the Uttarakhand Assembly.
