‘Himachal Rajya Sabha elections should be cancelled, by draw…’, Abhishek Manu Singhvi filed a petition in the High Court

Senior Supreme Court advocate Abhishek Manu Singhvi has challenged the process of Rajya Sabha elections in Himachal Pradesh High Court. Abhishek Manu Singhvi personally went to Himachal Pradesh High Court and filed a petition. It has been said in this petition that the rule of draw of lots under which the elections were lost is wrong. He has demanded the High Court to cancel this election.
In the petition filed by Abhishek Manu Singhvi, it is said that the one whose name comes out in the slip should lose the election. There is no such rule. It has just come into practice as a tradition. Challenging this process of draw of lots in the election, he has demanded cancellation of the election.
Abhishek Manu Singhvi and Harsh Mahajan both got 34-34 votes
Let us tell you that for the Rajya Sabha elections held in Himachal Pradesh, out of a total of 68, Abhishek Manu Singhvi of Congress got 34 votes and Harsh Mahajan of BJP also got 34 votes. After 34-34 votes were cast in both the sides, draw of lots was adopted as per the rules. The one whose name came out in the slip lost the election. Abhishek Manu Singhvi’s name came out in the slip and in this way Harsh Mahajan won the election.
6 Congress MLAs had cross voted
During the Rajya Sabha elections in Himachal, six Congress MLAs had cross voted. Due to which both BJP and Congress candidates got 34-34 votes. After which the toss was done under draw of lots and BJP candidate Harsh Mahajan won. At the same time, the party took action against the Congress MLAs who did cross voting and declared them disqualified. There was a lot of turmoil in the politics of Himachal during this time. After which the rebel MLAs joined the BJP.
