A bench of Justice BR Gavai and Justice Sandeep Mehta is hearing the Supreme Court’s petition filed by the Mamata government against the CBI investigation conducted without the approval of the state government in West Bengal. Solicitor General Tushar Mehta said that during the last hearing, the state government had alleged that ED and CBI enter the state without permission. Come to count the seized cash whereas cash worth Rs 50 crore was recovered from their current ministers and MPs.

On this, lawyer Kapil Sibal, on behalf of the West Bengal government, objected to the SG’s argument. Sibal said that agencies cannot enter the state without general consent or notification. Justice Gavai asked Sibal that the Central Government’s argument was that all the cases were registered on the orders of the High Court.

Sibal said that the High Court can do this and I have said the same in my application also. The agency is under the High Court, but the Center cannot interfere. Sibal said that when any question is asked on CBI in Parliament, the answer is given by the Department of Personnel and Training (DOPT). Ministers answer because it is headed by the Prime Minister.

SG Mehta said during the hearing that he does not have any YouTube channel to respond to any criticism of Sibal. SG was referring to the senior lawyer’s YouTube channel ‘Dil Se with Kapil Sibal’, in which he has been interviewing and discussing topical issues with various political leaders, lawyers and domain experts. Tushar Mehta made this argument before the bench of Justice BR Gavai and Justice Sandeep Mehta during the hearing of the case filed by the West Bengal government against the Central Government over the alleged misuse of CBI in matters related to the state.
