What is the whole matter?

In fact, the Telangana High Court had ordered a Muslim youth to pay alimony to his ex-wife on an interim basis. Against this order, the youth approached the Supreme Court in February 2024. The man had said in his petition that the alimony in this case should be governed by the provisions of the Muslim Women Act, 1986 instead of 125 CrPC.

What happened in the court?

While hearing the case, the Supreme Court has said that a Muslim woman is entitled to seek alimony from her husband under the ‘religion neutral’ section-125 of the CrPC. The Supreme Court bench of Justice Nagarathan and Justice George Masih, after hearing the case in detail today, has given two separate but concurrent verdicts.

What did the court say in the verdict?

Giving its verdict in the entire case, the Supreme Court said that an Indian married man should be aware that if his wife is not financially independent, then the husband will have to be available for her. Such empowerment will mean access to her resources. The court said that Indian men who do this from their personal or individual expenses help vulnerable women and the efforts of such a husband should be acknowledged.
