Uttarakhand: No relief to Mukesh Bora, accused of raping a woman and molesting a girl, High Court seeks response from the government

The Uttarakhand High Court heard the bail plea of ​​Mukesh Bora, president of Lalkuan Milk Union, accused of raping a woman and molesting a minor girl. After hearing the case, the single bench of Justice Ravindra Maithani, while not giving any relief to Mukesh Bora for the time being, has asked the state government to submit a reply in four weeks.

No relief to rape accused Mukesh Bora: Now the next hearing of this case will be after four weeks. Earlier also, the anticipatory bail plea and stay on arrest petition of rape accused Mukesh Bora have been rejected. The accused said that he should be granted bail, as he has been implicated in this case under a conspiracy. This incident is of 2021. After two years and eight months, a case has now been registered against him.

Mukesh Bora gave these arguments in the court: Accused Mukesh Bora argued that there is no allegation of molestation anywhere in the FIR. Therefore, the POCSO Act cannot be applied on him. The woman was repeatedly pressuring him to regularize her, while she was not an employee of the milk union but an employee of a company supplying manpower. When the tender of this company was canceled by him, they together implicated him under a conspiracy.

Government and victim opposed: This was opposed by the government and the victim. It was also said on behalf of the victim that the accused has exploited her since 2021 till now. She is being repeatedly threatened with death. They have all the evidence of this. While giving a statement in the lower court, the minor has said that she has been molested. Therefore, the section of POCSO is applicable on them. Therefore, their bail application should be canceled.
