Uttarakhand: Hearing on the petition of Almora MLA Manoj Tiwari, contempt notice issued to Secretary Urban Development and DM
The Nainital High Court heard the contempt petition filed by Almora MLA Manoj Tiwari for not complying with the previous order. After hearing the case, a single bench of Justice Alok Kumar Verma held the Secretary Urban Development and Almora District Magistrate guilty of contempt for not complying with the court order. Also, they have been issued a notice of contempt and asked to submit their reply by December 30. Now the next hearing of the entire case will be on December 30.
Actually, Almora MLA Manoj Tiwari had filed a PIL in the Nainital High Court in view of the public interest. He had said that the work of repairing and widening the road from NTD of Almora to Tuni of Dhar is to be done, which is very necessary. Because, there are many schools on this road, but due to the poor condition and narrowness of the road, school children have often been injured. Apart from this, due to traffic jam on the road, school children are also not able to reach school on time.
MLA Manoj Tiwari filed contempt petition for not following the order
In the month of June, the High Court, after hearing his PIL regarding the matter, had directed the government to investigate it and inform the court. But till now the government has not presented any reply to the court. For not following the previous order, he (MLA Manoj Tiwari) had to file a contempt petition against Almora Municipality, District Magistrate and Secretary Urban Development.
Today, during the hearing on Monday, the High Court was informed by the Almora Municipal Council that following the court’s order, the municipality sent the approval to the Secretary Urban Development and DM for sanctioning a budget of Rs 74.48 lakh for the repair and widening of the road, but till now the budget has not been received, nor has the court’s order been complied with. In such a situation, for disobeying the order, the court has issued a notice to the Secretary Urban Development and Almora DM, finding them guilty of contempt and has asked them to submit a reply.
