Assistant Controller of Meteorological Department Naseemuddin had filed a petition in the High Court. He had challenged his transfer. The court has now rejected his petition. The court said that his allegations are baseless. Naseemuddin was transferred to Chhindwara. He had alleged that he was transferred because he was a Muslim. He also said that this transfer was done at the behest of a local BJP leader.
The court rejected all the allegations
The court made important remarks in this case. The court said that if such baseless allegations are believed, it will become difficult to do administrative work. Any officer can give a communal color to any transfer. This will make it difficult for the government to work. Naseemuddin had said in his petition that he has been transferred so far from Ratlam with malice. He cited a document and said that it contains his name and the names of four other Muslim persons who were recommended for transfer.
The court gave these arguments
In this case, the government lawyer said that the petition has been filed with the intention of taking advantage of religion. He said that the transfer order is being given a communal color. A division bench of Justice Subodh Abhyankar heard the matter. He said that if such baseless allegations are accepted, there will be serious problems in the implementation of administrative orders. The court said that if an officer of the Muslim community transfers his non-Muslim subordinates, he can also be accused of communal bias. This can cause the state machinery to fail completely.
The court refused to accept malice
The court also said that as per the records, Nasimuddin was also given the additional charge of Deputy Controller, Legal Metrology Indore by the Controller of Legal Metrology on 22 October 2024. Therefore it cannot be said that the government has transferred him with malice.
