In its recent decision, the Supreme Court has advised the President to take a decision on the bill within three months. The Supreme Court has said that if the President does not take a decision within the time limit of three months, then he will have to give a valid reason for it. Due to the decision of the Supreme Court, the Governor will also not be able to keep the bill pending indefinitely. Kerala Governor Rajendra Arlekar has reacted sharply to this decision of the Supreme Court. He said that if the Supreme Court will also do the work of amending the Constitution, then what are the Parliament and Assemblies for.
Congress and CPIM criticized the statement of the Governor
Politics has heated up over this statement of the Kerala Governor and Congress and Kerala’s ruling party CPIM have criticized the Governor. CPIM General Secretary MA Baby called the Governor’s statement unwanted and Congress General Secretary KC Venugopal called Arlekar’s statement unfortunate. During a program in Kozhikode, KC Venugopal said that the Governor is criticizing the decision of the Supreme Court because he is afraid that now the agenda of the BJP will come out in the open. He said that it is unfortunate that the Governor of Kerala is against the decision of the Supreme Court.
‘It is wrong to criticize the Supreme Court’
CPIM leader MA Baby said that the decision of the Supreme Court will apply to everyone, including the President. When the President cannot delay the Parliament’s bill, then how can the Governor have the right which the President does not have? Baby said that all the governors should accept the decision of the Supreme Court, but it is clear from the statement of the Kerala Governor that he does not accept it. It is wrong for him to criticize the Supreme Court.
The Law Minister of Kerala expressed happiness over the decision of the Supreme Court and called it a victory of democracy and federalism. He said that being a law student, I think this is a very good decision. All sides have been examined in this. This will strengthen the Constitution as well as democracy and federalism.
The Governor of Kerala said that, ‘If the Constitution Amendment is done by the Supreme Court, then what is the need for the legislature and Parliament. If everything is decided by the honorable courts, then the need for Parliament ends. This is an encroachment on the judiciary. The Supreme Court should have referred this matter to a larger bench and not let the division bench decide on it.
