Rahul Gandhi will appear in person in Chaibasa court, the court had issued a non-bailable warrant

Leader of Opposition in Lok Sabha and senior Congress leader Rahul Gandhi will appear in person in Chaibasa’s MPMLA court on August 6. This information has been given  by his advocate Dipankar.

He told that a non-bailable warrant has been issued against him from Chaibasa court. He was asked to appear in person on June 26. A petition was filed in Jharkhand High Court for exemption from this. During the hearing on Tuesday, Rahul Gandhi’s advocate told that he should be allowed to appear on August 6 instead of June 26.

On this, the court of Justice Anil Kumar Chaudhary of the High Court agreed and ordered to postpone the non-bailable warrant till August 6. Let us tell you that a petition was filed on May 29 for exemption from appearing in person in Chaibasa court on June 26, which was heard on Tuesday.

In which case Rahul Gandhi has to appear

Actually, this case is related to Rahul Gandhi’s speech against BJP in the Congress session on 28 March 2018. On this, BJP leader Pratap Kumar had filed a defamation case against Rahul Gandhi in Chaibasa court. On 20 February 2020, on the order of Jharkhand High Court, that case was sent to the special court of MP-MLA in Ranchi.

Later the High Court sent this case to the Special Court of Chaibasa. Despite receiving the summons, Rahul Gandhi did not appear in the court. Then again a bailable warrant was sent from the court level. Despite this, Rahul Gandhi did not appear.

On this basis, the court had issued a non-bailable warrant against him. It was challenged in the High Court which was disposed of. Then a petition under CrPC 205 was filed on behalf of Rahul Gandhi requesting exemption from personal appearance. It was rejected by the lower court.

Earlier, a petition was filed in Ranchi court on Modi surname controversy. In this case, Rahul Gandhi has been exempted from personal appearance by the High Court. Whereas in another case of Chaibasa Court related to the statement against BJP and Amit Shah, a stay has been obtained from the Supreme Court.
