The judge asked questions to EC, then Sibal’s team gave this answer

The Supreme Court has upheld the decision of the Election Commission. A bench of Justice Sudhanshu Dhulia and Justice Joymala Bagchi on Wednesday also allowed the petitions filed by social activists Arshad Ajmal and Rupesh Kumar. During the hearing in the Supreme Court, senior advocate Kapil Sibal argued that a block level officer cannot be given the right to determine the citizenship of people. Only the Government of India can question the citizenship of a citizen. Such small officials do not have the right to do so. It is the job of the Election Commission to prove that the person whose name is not in the voter list is not a citizen of the country. Kapil Sibal argued that the documents prescribed by the Election Commission for special revision are possessed by very few people in Bihar. Only 2.5 percent people have passports and 14.71 percent people have matriculation certificates. Apart from this, the number of people holding Forest Rights Certificate, Residency Certificate, OBC Certificate is also nominal. The Commission has excluded birth certificate, Aadhaar and MNREGA card from the list. In fact, the bench of Justice Sudhanshu Dhulia and Justice Joymalya Bagchi sought answers from the Election Commission on three issues and asked whether it has the right to make such special revision in the voter list? Apart from this, the Supreme Court has also asked the Commission to file a reply regarding the procedure being adopted for special revision and when such revision can be done. The next hearing will be on July 28.
