Uttarakhand Bar Council took action against the advocate, suspended his license for 5 years

The Bar Council of Uttarakhand has taken major action against an advocate from Ramnagar, Nainital and found him guilty of professional misconduct. Under the Advocates Act 1961, the advocate registration has been suspended for five years. A fine of Rs 25,000 has also been imposed.
A strict action has been taken against the advocate resident of Ramnagar for not meeting the test of discipline and honesty in the legal world. The Disciplinary Committee of the Bar Council of Uttarakhand, Nainital, while hearing under Section 35 of the Advocates Act 1961, has suspended the advocate registration for 5 years.
This is the case: This action was taken on the basis of a complaint lodged in case number 16/2023, which was filed by advocate Mohammad Firoz. In the complaint, Mohammad Firoz had alleged that the advocate declared himself as an independent advocate without passing the All India Bar Examination (AIBE) and operated a legal office named Raza Law and Tax Solutions.
Whereas the name Raza Law and Tax Solutions was already registered as the legal office of complainant Mohammad Firoz. Due to this, confusion was being created among the general public and this case directly came under the category of professional misconduct.
Revelation in investigation: The Disciplinary Committee of the Bar Council took serious cognizance of the complaint and conducted a detailed hearing of the case. On the basis of evidence documents presented before the committee, cross-examination of witnesses and parties, it became clear that the advocate not only declared himself as an advocate without obtaining legal qualification. But also deliberately misused the name of an already established legal institution.
Clear message of Bar Council: The Disciplinary Committee said in its decision that this conduct of the advocate is against the dignity and ethics of the legal profession. The committee commented that such conduct tarnishes the image of the advocate profession in the society and it also weakens the trust of the common people. Apart from this, the committee also imposed a fine of 25 thousand. If the fine is not paid, the period of suspension will be extended for another six months.
Warning for Law Students and Newly Registered Advocates: This decision is a strong message for the newly registered and fresh entrant advocates of Uttarakhand that if any person declares himself as an advocate without completing the required examination and formalities or misuses any established name, then strict action will be taken against him by the Bar Council.
