The court was hearing a habeas corpus petition filed for the custody of a woman above the age of 18. The petition alleged that the woman had gone with a married man, while she should have lived with her parents. During the hearing, the lawyer told the court that the man with whom the woman wants to live has left his first wife and wants a divorce.

What did the MP High Court say?

According to the Bar and Bench report, the Madhya Pradesh High Court in its decision on August 18 said that the woman is an adult and has the right to decide with whom she wants to live. The court also clarified that if the woman wants to live with that person, whether he is already married or not, it is her personal decision. The woman also has the right to decide whether it is right or wrong. The court further said that there is no law that prevents a woman from living with a married man. The court cannot give any argument in matters related to morality and believes that the woman has the right to live with the person with whom she wants to live.

The court said that since the woman has refused to live with her parents, the police are requested to release her after taking an undertaking from the woman that she is going to live with the person of her choice and also take confirmation from the person with whom she is living that she has agreed to live with him.
