Uttarakhand: The High Court overturned the lower court’s decision, acquitted the person who was sentenced to life imprisonment, know the whole case

The Uttarakhand High Court heard a petition filed against the order of the District Sessions Judge of Almora district sentencing the accused Deepak Singh Bisht to life imprisonment in the year 2018. After hearing the case, the division bench of Justice Ravindra Maithani and Justice Alok Mehra acquitted him on the grounds that the charges leveled against him were not proved by the prosecutor.

The District Sessions Judge had passed an order in the year 2018 sentencing him to life imprisonment on the basis of murder. He was also punished with fine under Section 302 and 201 of the IPC. He was also punished with a fine of Rs 40,000 under Section 302 and Rs 5,000 under 201. In case of not paying the fine, he was to be sentenced to 7 years of additional imprisonment under Section 302 of the IPC and 6 months under Section 201.

This order was challenged in the High Court by Deepak Singh Bisht in the year 2018. Hearing this, the division bench found that the prosecution could not present any concrete evidence in the lower court. Taking advantage of this, the accused was acquitted. Along with this, the order of the lower court was cancelled.

According to the case, Pani Ram was working as a Gram Vikas Adhikari in the Gunaditya Horticulture Department of Almora. On the night of the incident, he was at a party with Deepak and was staying in the department building itself. There was no direct witness available as to why he died during the incident. When his wife was informed about this, she reached the spot with her nephew. There she saw that her husband was lying dead in the lower verandah of the office. There were injury marks on his head and he was bleeding. Not only this, there was blood on the upper stairs of the building, which someone also tried to clean, which was not completely cleaned.

While investigating the case, the police suspected Deepak Singh Bisht. On the basis of that, Deepak was arrested and a charge sheet was filed. District Sessions Judge Almora sentenced the accused to life imprisonment. The accused challenged the order in the High Court. Hearing the case, the High Court acquitted him as the charges were not proved.
