The Supreme Court has taken strict action against the SHO of a police station in Pratapgarh, Uttar Pradesh. The SHO had blatantly refused to obey court orders. Furthermore, he arrested and assaulted the petitioner, despite the court’s prior prohibition against such action. The SHO, while blatantly refusing to obey the court’s orders, declared, “I will not obey any Supreme Court order. I will remove all your High Courts and Supreme Courts today.”
A bench of Supreme Court Justices Arvind Kumar and N.V. Anjaria was hearing the case. The petitioner had complained that despite a protection order dated March 28, 2025, SHO Gulab Singh Sonkar dragged him from his workplace, arrested him, and beat him on April 23, 2025. The petition also stated that even when the petitioner showed him a copy of the Supreme Court order, the SHO abused him and refused to obey the court’s order, showing disrespect for it.
The court had already ordered the Uttar Pradesh Home Department to investigate the matter. The investigation was to be conducted by an officer not below the rank of ADGP. The court found that the official investigation report also confirmed deliberate disregard of the court order. The court stated that no officer can be allowed to subvert the course of justice under the guise of a police uniform.
What did the Supreme Court say?
The court stated that prima facie, the first respondent (SHO) had deliberately disobeyed the court order. Such cases must be dealt with strictly. The court was about to issue a strict order against the SHO. However, the government lawyer informed the court that immediate action would be taken against the SHO based on the investigation report. He requested time to inform the court of this matter. Accepting the government’s request, the court scheduled the next hearing for November 7, 2025.
