Vikas Kumar, who was convicted in a case of filing a false complaint under the SC/ST Act in a land dispute, has been sentenced to five years of imprisonment by Special Judge Vivekananda Sharan Tripathi of the SC/ST Act court.
The court also imposed a fine of ten thousand rupees on the convict and directed that any relief amount given to him in this case should be recovered.
The court stated in its order that the complainant is the most important witness in a case and must give truthful testimony before the court. If those who file false cases are not given strict punishment, the misuse of the law will increase.
Government lawyer Arvind Mishra stated that Vikas Kumar had filed a First Information Report (FIR) at PGI Police Station on June 29, 2019. He alleged that Om Shankar Yadav, Arun Kumar, Neetu Yadav, and Akhilesh Pal came to the site with the intention of seizing his land, hurled caste-based abuses at him, chased him away from the land, and threatened to kill him.
During the investigation, the police found no evidence of the accused’s presence at the scene of the incident. Independent witnesses also categorically denied any such incident.
The investigation also revealed that Vikas Kumar’s family had taken a loan from a bank against the land. When they failed to repay the loan, the bank auctioned the land. Om Shankar Yadav’s nephew, Kamlesh, purchased the land at the auction. This land dispute later led to Kamlesh’s murder, a case that is currently pending in court. Om Shankar Yadav was representing the family in that case.
According to the prosecution, the convict filed the false case under the SC/ST Act to prevent Om Shankar Yadav from pursuing the case and to put pressure on him. Upon finding the allegations to be false, the investigating officer filed a final report in court on December 26, 2019. Based on all the evidence and statements, the court convicted Vikas Kumar.
