The case of Tamil Nadu government imposing NSA on YouTuber Manish Kashyap has reached the Supreme Court. While hearing the matter, a bench of Chief Justice of India DY Chandrachud (CJI DY Chandrachud) and Justice JB Pardiwala said that the court has not yet been able to see the documents of the case. Will hear on April 10.

During the hearing in the Supreme Court, Manish Kashyap’s lawyer told that the case is related to violence on the workers of Bihar in Tamil Nadu. On this, Justice JB Pardiwala asked what relief do you want? Advocate said that NSA has been imposed on his client.

What did CJI Chandrachud say?

Manish Kashyap’s lawyer demanded Chief Justice of India DY Chandrachud to instruct the police to keep their hands away. Justice Chandrachud said that we will order not to take forceful action. On this, Senior Advocate Hegde told that Manish Kashyap is already in police custody. On this, CJI Chandrachud said that in this situation we cannot stop by forceful action. Justice Chandrachud said that we have not yet seen the papers of the case. In such a situation, the matter will be heard on the 10th.

Why is NSA imposed on Manish Kashyap?

Manish Kashyap is accused of sharing fake video Manish Kashyap had shared the video related to the alleged attack on Bihar migrant laborers in Tamil Nadu on social media. The police of Tamil Nadu and Bihar had declared the video fake. After this many FIRs were registered against Manish Kashyap one after the other. The police started searching for Kashyap. He finally had to surrender on 18 March. First the Bihar police interrogated, then the Tamil Nadu police took them on transit remand. Since then he is in judicial custody as per the orders of the court. Now the Tamil Nadu Police has also booked Manish under the National Security Act (NSA).

NSA i.e. National Security Act is imposed on that person, who threatens or threatens the security or harmony of the nation. This law was brought by the government in the year 1980 to be equipped with more powers. NSA can be used by DM, Collector and State Government within their committee purview. According to a constitutional expert, sub- clause-2 of section-3 of NSA gives the power of arrest to the government.

What happens when NSA is imposed?

After the NSA is imposed, the suspect can be taken into custody without any charges being framed. The first is detained for three months. After three months, its duration can be extended further for 3-3 months. Under the NSA, any suspect can be kept in jail for up to 12 months. The person can appeal before the Advisory Board of the High Court but a lawyer will not be allowed during the trial. The public prosecutor informs the court about the case and then the court examines the merits of the case.
