Life will not end! Supreme Court did not give permission to terminate pregnancy at 26 weeks
The Supreme Court has rejected the petition demanding termination of pregnancy at 26 weeks. The pregnant woman had filed an application in this regard, on which the apex court gave its decision after a long hearing. Earlier the court had said that we cannot end a life. The court also said during the hearing that the condition of the child is perfect and he should be born. If the woman does not want to keep the child, she can hand it over to the government and it will take care of it. The bench said that the fetus is 26 weeks 5 days old. There is no danger to mother and child. The growth of the fetus is absolutely normal. Therefore he should be allowed to be born.
In which it was said that the woman’s health was normal. He is in a position to take care of the child after its birth. The hospital said that the woman and her unborn baby are being taken proper care of. There is no deficiency in either and the fetus is developing properly. The AIIMS report said, ‘It has been found that the condition of the woman and her fetus is fine. He has been kept under proper medical observation. The condition of both is fine and there will be no problem even after the birth of the child. If any problem arises, the woman can be immediately admitted to the hospital.
After the AIIMS report, the bench of Chief Justice DY Chandrachud and Justice JB Pardiwala and Justice Manoj Mishra said that if the woman does not want to keep the child with her, then she can hand it over to the government after birth. Actually the woman said that her mental condition is not good and she is suffering from many diseases. In such a situation, permission should be given to abort the unborn child. In fact, according to Indian law, a fetus older than 24 weeks cannot be aborted. For this, doctors and concerned people can take any decision only after legal approval.
The two-member bench could not reach a consensus on the decision in this case on October 11. The reason for this was that the opinions of both the judges were different. Justice Hima Kohli said that the conscience of justice does not say that the fetus should be aborted. We do not have the right to end life. Justice Biwi Nagarathna said that a woman has the right to her own body. The fetus cannot be seen separately from its body. The fetus growing in the woman’s body is also hers. In this way, when a decision was not reached in the bench of two judges, the matter was sent to a three-member bench, from where the decision has now come in favor of not aborting the fetus.
