Cheated in online fraud, use your hands and feet a lot, these people do not get the money back, these are the guidelines of RBI

‘A junior resident doctor working in a big hospital in Delhi received a call to increase his credit card limit. They talked and suddenly a transaction of Rs 2 lakh happened and the limit was not increased. Two days passed in tension, on the third day a complaint was lodged with the police. Then he also went to the bank. I searched a lot, searched but did not get the money back…
‘Whereas a close friend of this doctor received a call and Rs 50,000 was stolen from his account. He complained to both the bank and the police on the same day. Within a few days, he got his entire money back.
Now the question arises that why did this happen? Online fraud happened to both of them, then one got the full amount, the other did not, why so? Today we are going to give you the answer to this question in detail.
Nowadays, as online fraud is increasing, the Reserve Bank of India is making strict safety rules to save the customers’ money and keeps issuing circulars from time to time. If any fraud happens to you, you can get money, but it is very important for you to be aware of these conditions of RBI.
When do you get the money back?
According to RBI, if fraud takes place due to lack of any information, lack of banking or any other means, whether it is done through phone, net banking, debit card, credit card or online payment gateway, then a complaint can be lodged. You can get money later. Apart from this, if money is lost from the account due to any third party breach in the system, in which neither the bank nor the customer is at fault, the money is also recovered.
But this is the condition..
However, RBI has clearly said in its guidelines that if a fraud happens to someone, then the bank will have to inform it in writing within 3 days of the incident. If the customer informs the bank within 4 to 7 days, there is still some possibility that the money can be refunded, but there are limitations for that too. After this, things will happen as per the policy of the Bank Board on giving information.
What do experts say, how to give information?
However, Delhi Police cyber expert Kislay Choudhary says that even though these are the guidelines of RBI, sometimes banks are reluctant to follow them and after a certain period of time, the customer is not able to get his money back.
Chaudhary advises that merely informing the bank after online fraud does not suffice. It is also important to know its complete process. If you want money back then you should do these 3 things.
- In case of online fraud, first give a written complaint of fraud to the nearest police station on the same day. If an FIR is lodged then it is fine, if not then file a complaint and get it received.
- Try to go to your bank for police receipt on the same day of the fraud or the next day. Write the fraud application there and submit it by adding the police receipt.
- The third important step is to immediately send the soft copy of both the copies to RBI’s email ID crpc@rbi.org.in, adding your bank’s email ID in CC. The sooner you do this work, the greater are the chances of getting your money back. It is mandatory to do this within 3 days.
How many days does it take to get the money?
Kislay says that once the information goes to RBI, the banks do their work properly, not only this, if there is a police complaint then the complete formalities are done from the customer’s side. Then you will not need to run anywhere. You get your money back within 3 to 21 days.
Who doesn’t get money back?
- Kislay says that people who inform the bank and the police, or give it to one of them, after a maximum of 7 days, do not get their money back.
- If someone has lost money in Bitcoin, online currency, online games or betting etc. then that money is not recovered.
- Even if someone has done the transaction intentionally and has been negligent even after informing the bank, the money is not returned.
