Kerala High Court denies interference in the marriage of Christian woman and Muslim leader of DYFI

The Kerala High Court on Tuesday refused to interfere with the decision of a Christian woman to marry a Muslim leader of the Democratic Youth Federation of India (DYFI), the youth wing of the Communist Party of India-Marxist. The woman’s decision sparked a political controversy in the state when her relatives called it a case of ‘love jihad’, but the woman clearly told the court that she was not illegally imprisoned and that she I don’t want to talk to my family at this time. The woman’s father Joseph had filed a Habeas Corpus petition alleging that his daughter was illegally detained and requested the police to direct that Joisna be brought before them. The High Court bench closed the habeas corpus petition filed by the woman’s father. The court, after interacting with the woman, found that they had entered into this relationship of their own free will and a notice related to this marriage under the Special Marriage Act has already been served.

A bench of Justices VG Arun and CS Sudha, after talking to the lady Joisna Marie Joseph, said, “She clearly stated that she (DYFI leader) Shejin decided to marry of her own free will and was forced to do so by someone.” not obliged to.’ “She (the woman) also stated that she does not want to talk to her parents or family at this time and she will do so later,” the court said in its order. The court told the woman’s family that she (the woman) has stated that she intends to meet him after her marriage, for which an application has been filed under the Special Marriage Act, which is under consideration and she cannot meet him before that. The bench told the family that it understands their concerns, but their daughter is a 26-year-old woman, who is a nurse in Saudi Arabia and is capable of taking her own decisions. The court said, ‘The woman has taken the decision and she stands by it. It is their wish and happiness. She doesn’t want to talk to her family right now, so how can we force her to do so. Here, Joisna’s father told reporters in Kochi that since the day his daughter left the house, he has not spoken to anyone, so he believes that Joisna’s husband has imprisoned her against her will. The inter-religious marriage has sparked a political controversy after relatives of the bride’s side alleged ‘love jihad’. The controversy escalated when a district level leader of the CPI(M) also accused Sheijin of love jihad. However, he later claimed to have distorted his statement.

‘Love Jihad’ is a term used by Hindutva outfits to convert Hindu women into marriage by allegedly forcing or luring them to marry a Muslim man. However, the Communist Party of India-Marxist (CPI-M) said that there is nothing unusual in inter-religious marriage and the campaign being run in the name of ‘love jihad’ is the brainchild of the Rashtriya Swayamsevak Sangh and the Sangh Parivar. The newly wed couple had denied the allegations made by Joisna’s family members.

According to The News Minute report, Joseph is a nurse in Saudi Arabia and she had come to Kerala to marry a man chosen by the family, but she and Shejin decided to garland each other on April 9. He had applied on April 12 to get his marriage registered under the Special Marriage Act. They will have to wait for 30 days to get their marriage registered. Meanwhile, Joseph’s family had filed a missing complaint, while the couple denied the family’s allegations.

According to the report, Joseph and Shejin appeared before a court in Thamarassery on April 12, which allowed them to live together. Shaijin clarified that the marriage was a natural confession of their love and that the controversy was unnecessary.

Dispute over marriage

However, despite the clarification of the newlyweds, the controversy regarding their inter-religious marriage continues. In Thiruvambadi, a section of the Christian community, including nuns, also protested against the couple’s relationship. CPI(M) district secretariat member George M. Thomas supported the allegations of love jihad. However, after the party’s district leadership intervened, Thomas told the media that communal forces had conveniently distorted his words to describe inter-religious marriage as ‘love jihad’.

However, he claimed that the marriage had hurt the sentiments of the Christian community. Condemning Thomas’s remarks, Kozhikode district’s CPI(M) secretary P. Mohanan said on April 13 that his party never termed inter-religious marriage as love jihad. “Love Jihad is a term coined by RSS and RSS affiliates to attack religious minorities. The CPI(M) has already clarified its stand on the matter. Marriage is the choice of two people and the legal system of the country allows adults to marry as per their choice. He said the controversial remarks of Thomas, who supported love jihad, should be seen as a slip of the tongue. Mohanan also said that DYFI leader Shejin could have avoided the controversy by informing the party leadership about the wedding plans.
