Yogi government filed SLP in Supreme Court against High Court’s decision

The state government on Thursday filed a special leave petition in the Supreme Court against the decision of the Lucknow bench of the Allahabad High Court regarding OBC reservation in local body elections. In the SLP, after the report of the Uttar Pradesh State Local Bodies Dedicated Backward Classes Commission, a request will be made on behalf of the government to approve holding elections with OBC reservation.
For OBC reservation in local body elections, the government has constituted Uttar Pradesh State Local Body Dedicated Backward Classes Commission. After constituting the commission, now the government has filed the SLP. In the SLP, the government has urged to stay the decision of the High Court, to approve the conduct of elections only after the report of the commission. Throughout the day on Wednesday, officials of the Urban Development Department and the Law Department were busy preparing to file the SLP from Lucknow to Delhi.
It’s three way
- Retired High Court Judge Ranganath Pandey believes that the Supreme Court can allow the government to conduct elections by determining the OBC reservation on the basis of the commission’s report. You can also set a time limit for this.
- If there is no relief from the Supreme Court, the central government can find a way to hold elections with OBC reservation by bringing a bill related to it in the Lok Sabha. But for that the consent of all the states will have to be taken. This path is difficult and it will take more time.
- The Supreme Court can also dismiss the SLP as the High Court’s decision is on the lines of the Supreme Court’s decision. Because it may be related to UP immediately but the matter is related to the whole country.
This could be a political decision
In the event of no relief from the Supreme Court and the Lok Sabha, the ruling BJP will try to give a message to the backward classes by giving tickets to the backward classes on 35 percent of the general seats in the body elections that even after the order of the Supreme Court, the BJP government has fixed the quota for the backward classes. More than reservation has been given.
