SC refuses to hear plea seeking worship of Shivling and carbon dating
The Supreme Court refused to hear a new petition for permission for worship and carbon dating on the ‘Shivling’ found in Gyanvapi. The Supreme Court said that take up the matter in the lower court. The Supreme Court has given exemption to the petitioner that he can raise the issue in the trial court. The court said that if the case is pending now, then it will not hear. The Supreme Court will wait for the verdict of the Varanasi court in the Gyanvapi case.
The Supreme Court said that the trial court will continue to hear the matter if it is maintainable. The Supreme Court will keep the matter pending and will hear in the first week of October. The Supreme Court told lawyer Hari Shankar Jain that you are a sensible lawyer, what you are demanding in the petition, you can demand it during the hearing of the arguments on the suit. You cannot make a demand under Article 32.
Justice Chandrachud said that according to our order, whether the petition of the Hindu side is maintainable or not, it is currently being heard in the lower court. It was told on behalf of the Masjid Committee that under Rule 7/11, the debate is going on in the lower court. We transferred the matter to the district judge. If the judge considers that the petition of the Hindu side is not maintainable, then this case will come to an end. But if he considers it maintainable, then the evidence will be kept. Let the lower court order come, we will keep your legal path open. If the verdict comes in your favor then the matter is over. Suppose if the lower court’s decision goes against you, then you have legal options.
What was demanded in the petition?
Seven women petitioners, including a lawyer, a professor and five social workers, have approached the Supreme Court. According to the petitioners’ lawyer Vishnu Shankar Jain, GPS is the safest, accurate and scientific method of checking this entire complex through electromagnetic radar, in which facts can be collected without tampering with anything. It has also been appealed to the Supreme Court that in view of the sentiments of Sanatan Dharma, the court should meet Gyanvapi and allow Kashi Vishwanath Temple Trust to establish Adi Vishweshwar Shivling near Vishwanath temple and worship it. Because around the Vishwanath temple in Kashi, the area of five kos i.e. about 15 kilometers is the area of Kashi’s presiding deity Vishweshwar. In the petition, a demand has been made to direct the Kashi Vishwanath Trust to take possession of the Shivling found in the Gyanvapi survey.
