The Kerala High Court, while hearing a case, said that unmarried mothers and children of rape victims can live in this country with the fundamental rights of privacy, liberty and dignity.  And he can only include his mother’s name in the documents.

Justice PV Kunhikrishnan said in an order that the child of an unmarried mother is also a citizen of this country.  No one can violate his fundamental right.  The court said that if someone interferes in his personal life, then the Constitutional Court of this country will protect his fundamental rights.

According to the reports, the names of the son of the unmarried mother and the father of the petitioner were different in her three documents. In this case, the court ordered the Registrar of Births and Deaths to delete the name of the father mentioned in the register at the time of birth of the petitioner.  Also said that on the request of the petitioner, a certificate should be issued by registering only the mother’s name as a single parent.

The court said in its order that she is not only an unmarried mother, but also a son / daughter of this great country India.  The court also said that the state should protect all citizens at par with other citizens without disclosing their identity and privacy.  The court also directed the General Education Department, Board of Higher Secondary Examination, UIDAI, IT Department, Passport Officers, Election Commission of India and State Election Commission to remove the father’s name from their records.
