Uttarakhand / Khatima : Father-son sentenced to five years in culpable homicide case

Additional District and Sessions Judge Dharam Singh has sentenced father and son to five years’ imprisonment for culpable homicide not amounting to murder. He has also been punished with a fine of five thousand rupees each.
Bhupal Ram, a resident of Lachhijhala in Sitarganj Kalyanpur area, had filed a report about the incident. In the Tahrir given to the police, he had told that on December 6, 2017, he had a dispute with some people of the neighborhood for evacuation from the drain near the house. Then the accused had abused and assaulted her. In this case, Sitarganj police had registered a case on 9 December. The plaintiff died 20 days after the incident.
On April 27, 2018, the police had filed charge sheets against three people, including a woman, in the court. The matter reached the court of Additional District and Sessions Judge on 26 August 2018. On behalf of the prosecution, Assistant District Government Advocate Faujdari Saurabh Ojha presented 11 witnesses.
After hearing the arguments of both the sides, Judge Dharam Singh found Ramayan and his son Anil Kumar guilty under section 304 and sentenced him to five years imprisonment and fine of five thousand rupees each. Section 323 has also been punished with imprisonment of six months and fine of one thousand rupees each, while Ramayana’s wife Aarti has been acquitted under section 504.
