Kapil Sibal said – After 50 years of practice in the Supreme Court, I have no hope left from this institution

While giving a statement, Rajya Sabha MP and senior advocate Kapil Sibal has said that even after practicing in the court for 50 years, he has no hope left from the Supreme Court. Kapil Sibal said that even if a historic decision is passed by the Supreme Court, it hardly changes the ground reality. Kapil Sibal was speaking at a People’s Tribunal event.

Kapil Sibal has expressed his dissatisfaction and displeasure over some recent Supreme Court judgments. The Gujarat riots also criticized the dismissal of petitioner Zakia Jafri’s plea and the Supreme Court’s decision to uphold the provisions of the Prevention of Money Laundering Act, which gave wide powers to the Enforcement Directorate. Let us inform that in both the cases, Kapil Sibal appeared on behalf of the petitioners.

Giving the example of the decision to declare Section 377 of the IPC unconstitutional, Kapil Sibal said that despite the pronouncement of the verdict, the ground reality remains the same. He said that freedom is possible only when we stand up for our rights and demand that freedom. He said that politically sensitive cases are assigned to a few judges and the verdict can be predicted in advance.

Addressing the recent PMLA judgment passed by the Supreme Court, Kapil Sibal said that the Enforcement Directorate has become extremely dangerous and has crossed the limits of personal liberty, reported law website Live Law. He said the judge presiding over the case had observed that the PMLA is not a penal statute, while the definition of ‘property derived from an offence’ under the PMLA, including the word offense, is punishable.

Let us tell you that Sibal had also disagreed with the court on the arrest of Mohammad Zubair last month. He had said that some members of the organization let us down for what has happened in the recent past and I bow my head in shame.
