Delhi : 2 AAP MLAs Akhileshpati Tripathi and Sanjeev Jha convicted in 7 year old case, 21 will be punished

A Delhi court today convicted two Aam Aadmi Party (AAP) MLAs for attacking police personnel by being part of a mob in a 7-year-old case. The court has convicted AAP MLAs Akhilesh Pati Tripathi and Sanjeev Jha of being part of an illegally assembled mob and abetting the attack on the police force. The sentence of the MLAs will be heard in the court on September 21. This case is related to the attack on Burari police station in the year 2015.
The court of Additional Chief Metropolitan Magistrate Vaibhav Mehta at Rouse Avenue Court convicted Akhilesh Pati Tripathi, MLA from Model Town seat and Sanjeev Jha, MLA from Burari, saying that both these MLAs wanted to teach a lesson to the police. The court, in its judgment, said that these two MLAs were not only part of the mob but were also instigating the mob. The court said that according to the statements of the eyewitnesses, he was trying to intimidate the police by displaying such force. Along with these two MLAs, the court has also convicted 15 others.
According to the prosecution, on February 20, 2015, the AAP MLA along with the mob reached Burari police station. There he misbehaved with many policemen. He alleged that the police was not taking action in the kidnapping case. The mob was demanding from the police that the accused be handed over to them. On being told that the police would not hand over the accused, the mob led by the MLAs attacked the police station.
During the hearing of the matter, the counsel for the AAP MLAs said that the protest for which the case was registered was peaceful. The defense lawyer said that his client MLA had reached there to pacify the crowd. For this argument, 14 defense witnesses were presented on behalf of the MLAs. These witnesses said that the MLAs had left the police station before the attack, while the court rejected the defense arguments and the statements of the witnesses, saying that there were contradictions in the statements of the defense witnesses.
The court also noted that contradictions were also found in the statements of Sanjeev Jha. The court also noted that the biggest contradiction in the statements made by the accused MLA and the defense witnesses was with regard to timing. In contrast to the time given by the MLA to leave the scene, the witnesses told another time.
Police proved crime
While hearing the whole matter, the court found that the police succeeded in proving the charges against the accused MLA Jha and Tripathi. The police certified that both the MLAs were present at the time of the incident. Even he had an important role in instigating the crowd.
Apart from the MLAs, these people were also convicted
Apart from both the MLAs, the court also ordered Balram Jha, Shyam Gopal Gupta, Kishore Kumar, Lalit Mishra, Jagdish Chandra Joshi, Narendra Singh Rao, Neeraj Pathak, Raju Malik, Ashok Kumar, Ravi Prakash Jha, Ismail Islam, Manoj Kumar, Vijay Pratap Singh, Hira Devi and Yashwant have also been blamed. However, apart from this, ten accused have been acquitted. The court has dismissed the charges of damage to government property and criminal conspiracy in this case.
Convicted of these offenses
The court found the AAP MLAs and others guilty of rioting, obstructing the work of a government servant, causing injury to a government servant and unlawful assembly.
